TickTalk Tech LLC (“TickTalk,” “we,” “us,” or “our”) designs connected smartwatches and services for families. We take children’s privacy seriously and design our child-directed services to give parents and legal guardians meaningful notice, choice, and control.

This Privacy Policy explains how we collect, use, disclose, retain, and protect Personal Information when you use TickTalk products and services. It is intended to comply with applicable privacy laws as amended, and applicable U.S. state privacy laws.

1. What This Privacy Policy Covers

This Privacy Policy applies to the TickTalk ecosystem, including:

TickTalk Website: myticktalk.com and related adult-directed e-commerce, support, account, activation, and service pages.
TickTalk App: the parental-control and family communication mobile application.
TickTalk Devices: supported TickTalk smartwatches, including TickTalk 4, TickTalk 5, TickTalk 6, and successor devices where this Policy is presented.
TickTalk Wireless: cellular, SIM/eSIM activation, U.S. wireless plans, travel/roaming services, and related account functions.
TickTalk Radio: curated music, audio, and wellness content and related parental controls.
T-Cloud: eligible backup, restoration, synchronization, and device-to-device transfer services.
TickTalk Care+: optional paid device protection, claims, repair/replacement, and related support.
Warranty and Customer Support: product registration, warranty eligibility, technical support, returns, repairs, replacements, and fraud prevention.

The TickTalk Website is intended for adults. TickTalk Devices are designed for children, and portions of the TickTalk App and connected services process information relating to children. Where this Policy uses “Child” or “Children,” TickTalk may apply similar child-focused safeguards more broadly to child device users.

2. Our Privacy Principles

We collect only information that is reasonably necessary for the feature or service being provided.
We do not sell Children’s Personal Information.
We do not use Children’s Personal Information for targeted or behavioral advertising.
We do not place third-party behavioral advertising on TickTalk Devices or child-directed portions of the TickTalk App.
We do not condition a Child’s participation in a feature on providing more Personal Information than is reasonably necessary for that feature.
We use service providers only as reasonably necessary to operate TickTalk services and require appropriate confidentiality, security, and use restrictions.
Parents can review, correct, delete, and control further collection or use of their Child’s Personal Information as described below.
We maintain data-retention and deletion practices designed to prevent indefinite retention of Children’s Personal Information.

3. Parental Notice and Consent

Before collecting Personal Information from a Child where parental consent is required by applicable law, TickTalk provides the Parent or legal guardian with notice describing the information we intend to collect, how we use it, whether and why it may be disclosed to service providers or other parties, and how the Parent can provide or refuse consent. The notice may include a link to this Privacy Policy.

TickTalk uses parental consent methods appropriate to the service, feature, and type of information involved. If we materially change a collection, use, or disclosure practice in a way that requires renewed parental consent under applicable law, we will provide updated notice and obtain new consent where required.

If a Parent does not provide consent within a reasonable period after we collect the Parent’s online contact information solely for the purpose of requesting consent, we may delete that contact information unless we have another lawful reason to retain it.

Separate consent for non-integral disclosures. TickTalk does not disclose Children’s Personal Information for targeted advertising or other non-integral third-party commercial purposes. If we propose in the future to disclose a Child’s Personal Information to a third party for a purpose that is not integral to the requested TickTalk service, we will provide the Parent with an appropriate notice and obtain separate parental consent before that disclosure where required by applicable law.

4. Information We Collect

A. Parent, Guardian, and Adult Account Information

Depending on the service, we may collect:

Name or nickname;
Email address and phone number;
Account login credentials or authentication information;
Relationship to the Child;
Billing and shipping address;
Order, subscription, activation, transaction, and customer-service information;
Communication preferences and consent records; and
Information an adult voluntarily provides to support, warranty, Care+, or other service teams.

B. Child Profile Information

A Parent may create or manage a Child profile and may provide:

Child name, nickname, or other profile label;
Profile image or avatar;
Date of birth or age information, when requested or voluntarily provided;
Gender, when optional and provided;
Device phone number;
Parent-approved contacts and contact labels; and
Preferences and settings selected by the Parent for the Child’s Device.

We encourage Parents to use a nickname or non-identifying profile label when a full legal name is not necessary.

C. Device, Network, and Technical Information

We may collect device and technical information necessary to activate, secure, troubleshoot, update, and provide service, including:

IMEI, TID, SIM or eSIM identifiers (including ICCID and, where applicable, eSIM profile or embedded-SIM identifiers), phone number/MSISDN, and other device or subscription identifiers;
Device model, hardware, OS/operating-system and app versions;
Network type, carrier, APN, connectivity, Wi-Fi and cellular status;
Battery, storage, diagnostic, crash, error, and service-performance information;
IP address and security logs; and
Feature settings and command/status information needed for parental controls and device operation.

D. Precise Location Information

Location is a core safety feature of TickTalk. When a TickTalk Device is activated and location services are in use, we may collect precise location and related information using GPS, Wi-Fi positioning, cellular network information, and other available location technologies. This may include latitude/longitude, location time, location method, network information, and location history where the Parent has enabled or uses a history feature.

We use location information to provide current location, location history, safety and emergency features, device recovery/support, and related service functions. We do not use a Child’s precise location for targeted advertising.

E. Contacts and Family Connections

To enable Parent-approved communications, we may collect:

Contact names or labels;
Phone numbers;
Relationship labels;
Profile images or avatars; and
Contact permissions, whitelist/approved-contact settings, and related communication settings.

Parents control which contacts are approved for Child communications, subject to product and network functionality.

F. Communications and User Content

Depending on the feature used, TickTalk services may process:

Voice and video call routing information;
SMS or text communications where the service supports them;
Voice messages and chat messages;
Photos, videos, emojis, animated images/GIFs, or other media sent through supported features;
Timestamps, sender/recipient identifiers, delivery state, and similar communication metadata; and
Content voluntarily submitted to customer support.

TickTalk processes communication content to transmit, store where required by the feature, synchronize, troubleshoot, secure, and support the requested service. We do not use the contents of Child communications for targeted advertising.

G. Activity, Fitness, and Device-Use Information

Depending on the Device and enabled features, we may process information such as:

Step counts, activity summaries, movement goals, exercise-related information, or other device-generated activity metrics;
Device usage statistics;
Feature interaction information; and
Child-selected or Parent-configured settings.

These features are intended for general wellness and family use and are not intended to provide medical diagnosis or treatment.

H. Purchase, Subscription, and Transaction Information

For purchases or paid services, including Devices, TickTalk Wireless, T-Cloud, TickTalk Care+, and other subscriptions, we may collect or process:

Products or services purchased;
Order number and transaction identifier;
Billing and shipping information;
Subscription status, renewal date, plan type, and service history;
Discount, coupon, refund, replacement, and warranty information; and
Limited payment-related information provided by our payment processors.

TickTalk does not generally receive or store complete payment-card numbers when payment is processed by a third-party payment processor.

I. Customer Support, Warranty, and Care+ Information

If you contact us for support or submit a warranty or Care+ request, we may collect:

Support communications;
Device identifiers and diagnostic information;
Purchase records and proof of purchase;
Shipping and return information;
Photos or videos of a Device or damage;
Claim descriptions and service history; and
Other information reasonably necessary to resolve the request or prevent fraud.

J. Website Information

When adults use the TickTalk Website, we and our Website service providers may collect:

IP address;
Browser and device information;
Cookie and similar technology identifiers;
Pages viewed and interactions;
Referral URLs;
Shopping-cart and checkout activity; and
Advertising or analytics information where permitted by law and your choices.

Website advertising and analytics practices are intended for adult Website users and are not used to target Children on TickTalk Devices or child-directed portions of the TickTalk App.

5. How We Use Personal Information

We may use Personal Information to:

Provide, operate, maintain, and improve TickTalk Devices, apps, wireless services, and family features;
Register and authenticate accounts;
Activate Devices, SIM/eSIM services, subscriptions, and paid features;
Provide location, calling, messaging, contacts, parental controls, safety functions, and device-management features;
Process orders, payments, subscriptions, Care+ plans, returns, replacements, and refunds;
Provide warranty and customer support;
Detect, investigate, and prevent fraud, abuse, unauthorized access, and security incidents;
Maintain service integrity, network performance, reliability, and diagnostics;
Send service-related messages, including account, subscription, safety, and support communications;
Comply with legal obligations and enforce our agreements; and
Protect the rights, safety, and security of users, families, TickTalk, and others.

For adult Website users, we may also use Personal Information for analytics, personalization, and marketing where permitted by applicable law and subject to available privacy choices.

6. When We Disclose Personal Information

We do not sell Children’s Personal Information.

We may disclose Personal Information in the following circumstances:

A. Service Providers

We use service providers to perform functions on our behalf, such as:

Cloud hosting and data storage;
Device infrastructure and communications;
Location and mapping services;
Wireless connectivity and telecommunications;
Payment processing;
Order fulfillment and shipping;
Customer support;
Security, fraud prevention, and diagnostics;
Email, SMS, and service notifications; and
Website analytics and advertising services for adult Website users.

Service providers may use Personal Information only as permitted by our agreements and applicable law and only for the service functions they perform for TickTalk.

B. Parent-Directed and User-Directed Disclosures

We may disclose information when a Parent directs us to do so, when a Parent adds or authorizes contacts, when a requested communication is routed to another user, or when disclosure is otherwise necessary to provide a Parent-requested feature.

C. Legal, Safety, and Security Disclosures

We may disclose Personal Information when we reasonably believe disclosure is necessary to:

Comply with applicable law, regulation, subpoena, court order, or legal process;
Respond to lawful requests from public authorities;
Protect the safety of a Child or another person;
Investigate fraud, security incidents, abuse, or violations of our terms; or
Protect the rights, property, or security of TickTalk, our users, or others.

D. Business Transactions

If TickTalk is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar corporate transaction, Personal Information may be transferred as part of that transaction subject to applicable law and appropriate safeguards.

7. Service Providers and Other Operators

TickTalk uses service providers to operate the services requested by families. These providers may process or maintain Personal Information only for the functions they provide and subject to applicable contractual, security, and confidentiality requirements. For questions about any operator or service provider described in this Policy, TickTalk is the designated contact and will respond to Parent inquiries regarding our child-data practices.

8. Specific TickTalk Services

A. TickTalk Wireless

TickTalk Wireless provides optional U.S. wireless plans, SIM/eSIM activation, and related connectivity services. Depending on the plan and Device, the service may involve:

Phone number assignment and management;
SIM/eSIM identifiers;
Carrier/network information;
Plan type, usage status, billing and renewal information;
Activation, suspension, cancellation, and porting-support information; and
Travel/roaming settings and service status where available.

Wireless providers may also process communications and network information in accordance with telecommunications requirements and their role in providing connectivity.

B. TickTalk Radio

TickTalk Radio provides curated music, audio, and wellness content designed for family and Child use. Depending on the feature, we may process:

Content selections and playback requests;
Saved favorites, playlists, or preferences;
Feature settings configured by the Parent; and
Technical and usage information necessary to deliver and improve the service.

TickTalk Radio is designed to avoid third-party behavioral advertising to Children. Content availability may depend on licensing arrangements and service providers.

C. T-Cloud

T-Cloud provides storage, backup, restoration, synchronization, and device-to-device migration functionality for eligible TickTalk services. Depending on the feature selected by the Parent, T-Cloud may store or process:

Child profile information;
Parent-approved contacts;
Photos and other supported user content;
Voice or chat content where included in the backup feature;
Device settings and preferences;
Location history where the Parent has enabled an eligible history feature; and
Backup metadata, timestamps, Device identifiers, and restore status.

We use T-Cloud data to provide the backup, restore, synchronization, migration, and support functions requested by the Parent. T-Cloud data is retained according to the service settings, account status, and retention practices described in this Policy.

D. TickTalk Care+

TickTalk Care+ is an optional paid device-protection service. To administer Care+, we may process:

Parent account and contact information;
Plan purchase and eligibility information;
Covered Device identifiers;
Claim date, type, description, and supporting information;
Photos or other evidence submitted with a claim;
Repair, replacement, shipping, and service-history information; and
Information needed to detect or investigate claim fraud or misuse.

We use this information only to administer the protection program, process claims, provide support, prevent fraud, and meet legal and accounting requirements.

9. Parental Rights and Choices

A Parent or legal guardian may contact TickTalk to:

Review the Personal Information collected from or about their Child;
Request correction of inaccurate Child information;
Request deletion of Child Personal Information;
Refuse to permit further collection or use of the Child’s Personal Information;
Withdraw previously provided consent, subject to legal and service limitations;
Request information about the types of Child Personal Information collected;
Request information about the purposes for which Child Personal Information is collected and used; and
Request information about the types of service providers or other parties to whom Child information may be disclosed.

If a Parent refuses or withdraws consent necessary for a feature, we may disable or delete the affected Child profile, feature, content, or service if it cannot reasonably operate without that information.

How Parents Can Submit a Request

To help us process the request, please include:

The Parent’s name and account email or phone number;
The Child profile or Device involved;
The Device IMEI/TID or order number, if available; and
A description of the request.

We take reasonable steps to verify that the person exercising rights regarding a Child’s Personal Information is the Child’s Parent or legal guardian before providing access to, correcting, or deleting that information. Verification may use account authentication, Device identifiers, order information, or other reasonable methods. We will not require more information than reasonably necessary for verification.

10. Data Retention and Deletion

TickTalk retains Personal Information only for as long as reasonably necessary for the purpose for which it was collected, to provide the requested service, to maintain security and fraud-prevention records, to comply with legal obligations, and to establish or defend legal claims.

Retention periods vary by data type and service. For example:

Account information may be retained while an account remains active;
Subscription and transaction records may be retained as required for billing, tax, accounting, warranty, and legal purposes;
Communications or user content may be retained for the period necessary to provide the applicable feature;
T-Cloud information may be retained while the applicable storage or backup service remains active and for a limited period afterward to support account recovery or deletion processes;
Location information is retained according to the applicable feature, Parent settings, operational requirements, and legal obligations; and
Security and fraud-prevention logs may be retained for a reasonable period to protect users and our services.

When Personal Information is no longer reasonably necessary, we delete it, de-identify it, or otherwise render it inaccessible, subject to lawful exceptions.

11. Data Security

TickTalk uses reasonable administrative, technical, and physical safeguards designed to protect Personal Information from unauthorized access, destruction, loss, misuse, alteration, or disclosure.

Safeguards may include:

Encryption in transit and, where appropriate, at rest;
Access controls and authentication;
Role-based access restrictions;
Network and infrastructure safeguards;
Logging and monitoring;
Security review and vulnerability management;
Data minimization and retention controls; and
Service-provider security requirements.

No system is completely secure, and we cannot guarantee absolute security. Parents should use strong passwords, protect account credentials, keep Device software current, and contact us promptly if they believe an account or Device has been compromised.

12. International Data Transfers

TickTalk’s services may use infrastructure and service providers located in the United States and other countries. As a result, Personal Information may be processed in a country different from the country where the user resides.

Where required by law, we use appropriate safeguards for cross-border transfers of Personal Information.

13. California and Other U.S. State Privacy Rights

Residents of certain U.S. states may have additional privacy rights under applicable state law, including rights to:

Know or access certain Personal Information;
Request deletion;
Request correction;
Obtain a portable copy of certain information;
Opt out of certain targeted advertising, sale, or sharing; and
Appeal certain privacy-request decisions.

These rights vary by state and may be subject to exceptions.

For adult Website users, TickTalk may use cookies, pixels, or similar technologies for analytics or advertising. Where required, we provide mechanisms to opt out of sale, sharing, or targeted advertising, including recognized browser-based preference signals where applicable.

These adult Website privacy rights are separate from the rights Parents may have regarding Children’s Personal Information. We do not knowingly sell or share Children’s Personal Information for cross-context behavioral advertising.

14. Cookies and Similar Technologies

TickTalk’s adult-directed Website may use cookies, pixels, SDKs, local storage, and similar technologies for:

Website functionality;
Shopping-cart operation;
Fraud prevention and security;
Analytics;
Performance measurement;
Advertising and campaign measurement; and
Preference management.

You can manage cookies through available Website tools and your browser settings. Some cookies are necessary for the Website to operate and cannot be disabled through preference tools.

TickTalk does not use third-party behavioral advertising technologies on Child Devices or child-directed portions of the TickTalk App.

15. Changes to This Privacy Policy

We may update this Privacy Policy to reflect product, service, legal, security, or operational changes. We will update the “Last Updated” date above. If a change materially affects previously consented-to collection, use, or disclosure of Children’s Personal Information, we will provide Parents with appropriate notice and obtain new parental consent where required by applicable law.
